ACTU Droit social – rupture conventionnelle par Emilie YVART

Par décision en date du 13 mars 2024, la Cour de Cassation a rendu un arrêt apportant une précision importante en matière de rupture conventionnelle.

Elle estime en effet que l’article L1237-12 du Code du Travail n’instaure aucun délai entre l’entretien pour la rupture conventionnelle et la signature de la convention de rupture.

Dès lors, l’entretien pour la rupture et la signature de la convention de rupture peuvent avoir lieu le même jour. (Cass, 13 mars 2024, 22-10.551)
